Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bottle Bill App ("Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and you represent and warrant that you have authority to bind that organization.
1. Definitions
- "We", "us", and "our" refer to The WeighPay Group Inc., provider of the Bottle Bill App.
- "You" and "Customer" mean the organization or person using the Service.
- "Order" means the selection of plan, quantity (e.g., locations), and any add‑ons via the checkout or agreement with us.
2. Accounts and Eligibility
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activities that occur under your account.
3. Free Trial and Payment Method Pre‑Authorization
We may offer a time‑limited free trial (e.g., 15 days). To begin, a valid payment method is required. We may place a temporary authorization (e.g., $1) to verify the card; this hold is voided. At the end of the trial, your subscription renews automatically unless you cancel as described below.
4. Plans, Pricing, and Add‑ons
Your monthly price is based on your plan, number of locations, and selected add‑ons. Taxes may apply. We may update prices with notice before your next billing period. Any changes you make to your Order (e.g., adding locations or features) will be prorated where applicable.
5. Billing, Renewals, and Cancellations
- Subscriptions bill in advance and renew automatically each month until canceled.
- You may cancel anytime, effective at the end of the current billing period.
- Except where required by law, fees are non‑refundable. We may suspend or terminate access for non‑payment.
6. Provisioning and Onboarding
After successful checkout, we provision your workspace (tenant), locations, roles, and (if provided) user accounts. You are responsible for the accuracy of onboarding information.
7. Acceptable Use
- No unlawful, harmful, or infringing use of the Service.
- No attempts to breach, probe, or circumvent security or rate limits.
- No misuse of integrations (e.g., scale, camera, printing) in ways that violate laws or third‑party terms.
8. Data Ownership and Security
You own your transactional data. We process it to provide and improve the Service and to comply with law. We implement reasonable administrative, technical, and physical safeguards; however, no system is perfectly secure.
9. Privacy
Our handling of personal information is described in our Privacy Policy. Where you supply data about your customers or employees, you are responsible for having a lawful basis to do so and complying with applicable privacy laws.
10. Third‑Party Services
Some features rely on third‑party services (e.g., Stripe for billing, printers, camera storage). Your use of third‑party services is subject to their terms; we are not responsible for their actions or outages.
11. Service Changes and Availability
We may modify features, add or remove integrations, or update the Service. We aim for high availability but do not guarantee uninterrupted service.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE DURING THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14. Indemnification
You will defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
15. Suspension and Termination
We may suspend or terminate access immediately for material breach, non‑payment, suspected misuse, or legal risk. Upon termination, your right to use the Service ceases, but certain provisions (e.g., fees owed, limitations of liability) survive.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict‑of‑law principles. The exclusive venue for any dispute shall be the state or federal courts located in Nevada, and you consent to jurisdiction there.
17. Changes to Terms
We may update these Terms from time to time. If changes are material, we will provide notice (e.g., in‑app or via email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
